- Clearance of Site from Environmental Angle
As per press Note No. 17 (1984 series) of the Govt. of India, 20 categories of highly polluting industries in “Large & medium scale” sector (Annexure-VII) are required to obtain clearance of site from environmental angle. For this purpose, the Govt. of Punjab has constituted a State Competent Authority with the Principal Secretary to Govt. of Punjab, Department of Science, Technology & Environment as its Chairman and the Chairman of the Punjab Pollution Control Board, as its Member Secretary. Any industry covered under these categories of industries is required to submit an application to Member Secretary, State Competent Authority, C/O Punjab Pollution Control Board, Nabha Road, Patiala (10 copies) on the prescribed format. The application should be accompanied by the documents/enclosures mentioned in application form.
- Site Clearance from Site Appraisal Committee (SAC)
The industries irrespective of their scale (Large/Medium/Small) which are covered under the first schedule (Annexure-VIII) appended to the Factories Act, 1948, are required to obtain site clearance from the Site Appraisal Committee (SAC) before obtaining ‘consent to establish’ (NOC) of the Board. The Govt. of Punjab has constituted Site Appraisal Committee (SAC) with Principal Secretary to Govt. of Punjab, Department of Science, Technology & Environment as its Chairman and Chairman of the Punjab Pollution Control Board, as its Member Secretary.
For obtaining clearance of site from the SAC, the entrepreneur is required to submit an application (9 sets) to the Member Secretary of the said Committee. The application form can be had from the office of the Member Secretary, SAC, C/o Punjab Pollution Control Board, Nabha Road, Patiala.
In case, the industry in large/medium scale sector and is covered in the first Schedule appended to of Factories Act, 1948 as well as under the provisions of Press Note 17 (1984 series) of Govt. of India, the industry shall submit the common application form to the Member Secretary of the State Competent Authority-cum-Site Appraisal Committee (SAC)and the clearances as required under the Factories Act, 1948 and Press Note 17, will be accorded by the said Committee and thereafter, the Board shall grant NOC to the industry on the same application.
- Restriction on the burning of certain type of fuels/ materials
The Govt. of Punjab vide its notification no. 4/46/92-3ST/2839 dated 29/12/1993 has banned the use and burning of rubber scrap, all tyres, oil sludge, acid sludge and loose rice husk as fuel, in the whole of the State of Punjab as per details given below:-
- Rubber in any form with effect from 1/4/1994
- Process waste containing sulphur and toxic substances with effect from 1/4/1994.
- Rice Husk (except in the form of fuel briquettes and use of rice husk in fluidized bed combustion) as fuel in the air pollution control area with effect from 1/4/1994.
Environmental Statement
Every person carrying on an industry, operation or process and requiring consent under section 25/26 of the Water (Prevention & Control of Pollution) Act, 1974 and /or u/s 21 of the Air (Prevention & Control of Pollution) Act, 1981 or both or authorisation under the Hazardous Wastes (Management & Handling) Rules, 1989 as amended from time to time shall submit an Environmental Statement for the Financial year ending 31st March on prescribed proforma (Annexure-XII) on or before of September every year beginning 1993. Prescribed proforma can be obtained from the concerned Regional Office of the Board and the statement shall be submitted to the same office.
