Exemption from obtaining the ‘Consent to Establish’
The Board vide its Notification No. EE–1/Gen-1/F. No. Gen 214/F-2 dtd. 31.8.2000 has exempted 95* types of tiny/small scale industries (Annexure-I) from obtaining consent of the Board under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 and Hazardous Waste (Management & Handling) Rules, 1989, if the unit satisfies the following conditions:
- That the industry is established/being established in the State demarcated Industrial Estates /Zones classified by the State Authorities viz PSIEC, Department of Industries, PUDA, Chief Town Planner under draft master plan or any other authority appointed under the statute of the State for the development of industrial activities and shall not be applicable to the category of industries established/being established in predominantly residential areas and approved residential areas.
- That the investment of the industry is not more than Rs. 25.00 lacs on plant and machinery.
- That there will not be any discharge of trade effluent from the industry into stream or well or sewer or onto land and/or that industry will not discharge any air pollution including noise into the atmosphere.
- That the industry will not discharge any toxic/hazardous wastes and will not handle any toxic /hazardous chemical.
In case the industry is found to create conditions that generate any type of pollution or if there is any objection from the surrounding community and if on verification, it is found that such objection has some substance, the Board shall be free to take legal action against the industry under the provisions of the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 or Environment (Protection) Act, 1986 as considered appropriate.
Punjab State Power Corporation Ltd. has been authorized to release power connection to such units (95 types) after obtaining an Affidavit on a non-judicial stamp paper as per (Annexure-II).
*The number of such industries is liable to change from time to time subject to review by the Board.

In partial modification of the Board notification No. EE-1/Gen-1/F.No. Gen-214/F-178/2 dated 28.4.1998. Punjab Pollution Control Board, Patiala in its 107th meeting held on 07.07.2000 has decided to exempt 32 additional types of tiny/small scale industries in addition to 63 types of tiny small scale industries already exempted by the Board vide above referred notification. Accordingly, 95 industries under tiny/small scale sector as per Annexure-I are exempted from obtaining consent of the Board under the provisions of the Water (Prevention & Control of Pollution)Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 and Hazardous Waste (Management & Handling) Rules, 1989, subject to the respective industry satisfying the following conditions:
- That the industry is established/being established in the State demarcated Industrial Estates/Zones classified by the State authorities viz PSIEC, Department of Industries, PUDA, Chief Town Planner under draft master plan or any other authority appointed under the statute of the State for the development of industrial experts and shall not be applicable to the category of industries established/being established in predominantly residential areas and approved residential areas.

- That there will not be any discharge of trade effluent from the industry into stream or well or sewer or on to land due to the establishment or operation or process or any treatment and disposal or an extension or addition thereto.
- That the industry will not discharge any air pollutant including noise into the atmosphere.
- That the industry will not discharge any toxic/hazardous wastes & handle any toxic/hazardous chemical or process.

Exemption of Information Technology industries from the purview of consent management
In view of the Govt. notification no. 5/58/2002/ 11B/ 968 dated 26/3/2003 and State Govt. letter no. US/CO(PCB)/2k3/1226 dated 27/5/2003, Punjab Pollution Control Board in its 122nd meeting held on 5/3/2004 has decided to exempt the information technology industries (which are not covered under the Board's office order no. EE-1/Gen-I/F.No. 214/F-2 dated 31/8/2000), from the purview of the consent management for a period of one year purely on administrative grounds. The exemption is extended to the following:
- Persons establishing or taking steps to establish information technology software industries.
Provided that where the number of workers in such industries exceeds 300 and there exist no sewerage facilities, no exemption shall be available.
- Persons establishing or taking steps to establish information technology Hardware Industries, from the Consent Management except those electroplating, heat treatment and painting processes.
Provided that where the number of workers in such industries exceeds 300 and there exist no sewerage facilities, no exemption shall be available.
- In addition to 1 & 2 of above, persons establishing or taking steps to establish information technology industries, wants to install a D.G. set of 10 KVA capacity (Maximum) and with proper canopy so as no noise pollution is generated, will also be eligible for such exemption.
